Smog Tech Institute, Inc. Smog Tech Institute permits the limited download of
the content from the Site for your personal use; however, the content may not
otherwise be copied or redistributed and may not be modified.

trademarks, service marks or logos of the respective owners.

REPRESENTATIONS OR WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING,
BUT NOT LIMITED THE IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR PARTICULAR
PURPOSE AND NON-INFRINGEMENT. You assume total responsibility and risk for your
use of this Site and Site related services. Smog Tech Institute, its affiliates
and its sponsors, are neither responsible or liable for any direct, indirect,
incidental, consequential, special, exemplary, punitive or other damages arising
out of or relating in any way to the Site, Site related services and/or content
or information contained within the Site. Your sole remedy for dissatisfaction
with the Site and/or Site related services is to terminate use of the Site
and/or those services.
4.As noted above, although Smog Tech Institute attempts to ensure the integrity
and accurateness of the Site, it makes no guarantees whatsoever as to the
correctness or accuracy therein. It is possible that the Site could include
inaccuracies or errors, and that authorized additions, deletions and/or
alterations could be made to the site by third parties. In the event that an
inaccuracy arises, please inform Smog Tech Institute so it can be corrected.
5. Clicking on certain links within the Site will take you into other websites
for which Smog Tech Institute takes no responsibility.
6 You may terminate your account any time by e-mailing webmaster@Smog Tech
Institute.com . Smog Tech Institute may modify, suspend or terminate this
Agreement, or the account, at any time and for any reasons without prior notice
to you and without refunding any fees you have paid to Smog Tech Institute. Smog
Tech Institute also reserves the right to require you to change your login name
or password, and to delete any and all program or data files associated with the
account upon termination of this agreement.
7. Members will refrain from posting negative or derogatory or inflammatory
messages. Smog Tech Institute reserves the right to immediately remove any
messages deemed to be inappropriate. Repeated violations can result in
suspension or revocation of membership.
8. Smog Tech Institute reserves the right to increase fees, surcharges, and
monthly membership fees or to institute new fees at any time upon thirty (30)
days prior notice.
9. You certify to Smog Tech Institute that you are not a minor, i.e., that you
are at least 18 years of age; provided, however, that a minor's parent or legal
guardian may authorize a minor to use his/her account under supervision of the
parent or guardian.
10. For purposes of identification, billing and marketing, you agree to provide
Smog Tech Institute with accurate, complete and updated information required by
registration to the Site, including your legal name, address, telephone number
and applicable payment data (e.g., a credit card number and expiration date.)
You agree to notify Smog Tech Institute within (15) days of any changes to your
registration data. Failure to comply with this position may result in immediate
suspension or termination of your right to use the Site.
11. You are solely responsible for maintaining the confidentiality of your
password and agree that Smog Tech Institute will have no obligation with regard
thereto.
12. Smog Tech Institute reserves the right to reveal any registration data or
other information in its possession regarding users of the Site in cooperation
with request or investigation by any governmental body or governmental agency.
13. You acknowledge the transmission made to the Site are not confidential and
that your communications may be read or intercepted by others. Any non-personal
information, communications or materials sent by you to Smog Tech Institute or
to the Site are of a non-confidential basis. Smog Tech Institute may use and
reproduce any such information freely and for any purposes whatsoever.
Specifically, Smog Tech Institute reserves the right to use any ideas, concepts,
know-how or techniques contained in any such transmissions for any purpose,
including developing or manufacturing its own products.
14. You represent and warrant to Smog Tech Institute that you will not transmit
to the Site any materials of any kind which (1) violate, plagiarize or infringe
the intellectual property or contractual tights of any third party (2) contain
libel, defamatory, obscene, pornographic, abusive or otherwise unlawful
material, (3) contain software viruses or any malicious code designed too
interrupt, destroy or limit the functionality of any computer software or
hardware or telecommunications equipment. You further represent and warrant to
Smog Tech Institute that your use of the Site will at all times comply with all
applicable laws, rules and regulations. You hereby agree to indemnify, defend
and hold Smog Tech Institute and its employees, licensors, independent
contractors, providers, subsidiaries and affiliates from and against any and all
liability and cost incurred by such in connections with any claim arising out of
any breach by you of the foregoing representations, warranties and covenants,
including, without limitation, attorney’s fees and costs. You shall cooperate as
fully as reasonably required in the defense of any claim. Smog Tech Institute
reserves the right, at its own expense, to assume the exclusive defense and
control of any matter otherwise subject to the indemnification by you and shall
not in any events settle any matter without the written consent of Smog Tech
Institute.
15. Smog Tech Institute reserves the right to withdraw products referred to at
the Site at any time and to modify this Agreement. Any modifications is
effective immediately upon either a posting on the Site or upon notice by
electronic mail, or U.S. mail. Your continued use of the Site following notice
of any modifications to this agreement shall be conclusively deemed as an
acceptance of all such modifications. Your only right with respect to any
dissatisfaction with any modification made pursuant to this provision, or any
policies or practices of Smog Tech Institute in providing the Site, including,
without limitation (1) any change to content of the Site or (2) any change in
the amount of type of service fees, is to terminate membership by delivering
notice to Smog Tech Institute. Such notice will be effective upon receipt by
Smog Tech Institute.
Privacy Policy
Smog Tech Institute takes care to respect the privacy of its on-line visitors.
Information that can identify an on-line visitor may be collected at the Site
when voluntarily offered by the visitor. The Site may also collect non-personal
information from on-line visitors in order to track the total number of visitors
